Terms of Service

These Terms of Service ("Terms") govern your use of the QuickPoll mobile application ("App") operated by Royal Nation LLC. By using QuickPoll, you agree to these Terms.

1. ACCEPTANCE OF TERMS

By downloading, installing, or using QuickPoll, you agree to be bound by these Terms. If you do not agree, do not use the App. You must be at least 13 years old to use QuickPoll.

2. LICENSE TO USE

We grant you a limited, non-exclusive, non-transferable, revocable license to use QuickPoll for personal, non-commercial purposes.

You may NOT:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove or alter any copyright, trademark, or proprietary notices
• Rent, lease, sell, or sublicense the App
• Use the App for commercial polling without our permission

3. USER ACCOUNTS & DEVICE IDS

QuickPoll does not require an account for basic use. However:

• We use device identifiers to prevent duplicate voting
• Premium subscribers must provide a valid email address
• You are responsible for keeping your device secure
• You may only use one device ID per person per poll
• Attempting to manipulate polls through multiple devices is prohibited

4. ACCEPTABLE USE POLICY

You agree to use QuickPoll responsibly and NOT to:

• Create polls with illegal, abusive, hateful, or offensive content
• Use the App to harass, bully, or harm others
• Manipulate poll results through bots, scripts, or fake votes
• Share polls containing private information without consent
• Use the App for phishing, scams, or fraudulent activity
• Spam users with excessive polls or notifications
• Violate any local, state, or federal laws
• Interfere with the App's operation or infrastructure

5. POLLS & VOTING

Poll Creation

• Free users: 20 polls per month
• Premium users: Unlimited polls
• You are responsible for the content of your polls
• We reserve the right to remove inappropriate polls

Voting Rules

• One vote per device per poll (enforced by device ID)
• Votes cannot be changed after submission (by default)
• Poll creators may enable anonymous voting
• Votes are final when a poll closes

Poll Sharing

• Shared poll links are public unless set to private (Premium)
• Anyone with the link can vote (unless password-protected)
• You are responsible for how you share poll links

6. PREMIUM SUBSCRIPTIONS

Subscription Details

• Premium costs $2.99/month or $19.99/year
• Billed through Apple App Store or Google Play Store
• Auto-renews unless canceled 24 hours before renewal
• Subscriptions can be managed in your device settings

Refunds

• No refunds for partial subscription periods
• Refunds subject to Apple/Google refund policies
• Contact us for billing issues

Cancellation

• Cancel anytime through your device subscription settings
• Access remains active until end of billing period
• No prorated refunds upon cancellation

7. USER CONTENT & OWNERSHIP

You retain ownership of poll questions, voting options, and other content you create. However:

• You grant us a license to store, display, and process your content to operate the App
• Public polls may be visible to anyone with the link
• We may use anonymized, aggregated data for analytics
• We may showcase example polls in marketing (with your consent)

8. INTELLECTUAL PROPERTY

The QuickPoll name, logo, design, features, and functionality are owned by Royal Nation LLC and protected by copyright, trademark, patent, and other intellectual property laws. You may not use our branding without written permission.

9. DATA RETENTION & DELETION

• Free users: Polls deleted 90 days after closing
• Premium users: Polls stored indefinitely (unless you delete them)
• You can delete individual polls or your entire account anytime
• Deleted data is permanently removed within 30 days
• Some anonymized data may be retained for analytics

10. TERMINATION & SUSPENSION

We may suspend or terminate your access to QuickPoll if you:

• Violate these Terms of Service
• Manipulate polls or voting results
• Engage in abusive or fraudulent behavior
• Upload illegal or harmful content

You may delete your account at any time. Upon termination, your access ends immediately, but some data may be retained as described in our Privacy Policy.

11. DISCLAIMERS & WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We do NOT guarantee:

• Uninterrupted, error-free, or secure service
• Accuracy of vote counts or results
• That the App will meet your expectations
• That polls will always reach a majority decision
• That shared links will work indefinitely

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROYAL NATION LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Lost profits, data, or business opportunities
• Decisions made based on poll results
• Disputes between poll participants
• Third-party access to your polls

Our total liability shall not exceed the amount you paid us in the past 12 months (max $19.99).

13. INDEMNIFICATION

You agree to indemnify and hold harmless Royal Nation LLC from any claims, damages, or expenses arising from your use of QuickPoll, your violation of these Terms, or your violation of any rights of others.

14. CHANGES TO TERMS

We may modify these Terms at any time. When we do:

• We'll update the "Last Updated" date
• We'll notify you via in-app notification
• Continued use after changes means you accept the new Terms
• Material changes require your explicit consent

15. GOVERNING LAW & DISPUTES

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration in Dallas, Texas, except that you may assert claims in small claims court.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
